TERMS OF SERVICE – Trail Guide Content Club

By checking the box next to these Terms of Service and clicking the “Purchase” button, you, the purchaser of Trail Guide Content Club (“Customer” or “You”) agree to purchase this subscription provided by Niki Puls and Trail Guide Creatives (“Company”, “We”, “Our”, or “Us”) and agree to enter into this legally binding agreement, with terms as follows:

For good and valuable consideration, Customer agrees to purchase Trail Guide Content Club, a subscription membership from Company. In exchange, Company agrees to provide access to the purchased membership, with details as outlined below.

ACCEPTANCE OF THE TERMS
These Terms of Service are entered into by and between You and Company. The following terms and conditions ("Terms of Service") govern your access to and use of Trail Guide Content Club.

Please read the Terms of Service carefully before you start to use the Website. By using the Website or by clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the membership.

This Website is offered and available to users who are 18 years of age or older. By using this Website, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website or purchase our goods and services.

MEMBERSHIP DETAILS
Trail Guide Content Club is a digital monthly subscription membership.

A) Customer understands and agrees this subscription includes:

Ongoing access to content marketing resources (e.g., templates, tutorials, trend alerts, social media strategies)

Membership portal access for trainings and guides

Weekly or monthly new content drops (as advertised)

Group feedback opportunities and community access

Other benefits as described at time of purchase

B) Customer understands and agrees this purchase does NOT include:

Private 1:1 coaching or individualized content audits

Access to other paid products such as The Mastermind, TikTok Toolkit, or paid courses not explicitly listed in Trail Guide Content Club

Social media management or ads management

Custom done-for-you content services unless separately purchased

Customer has done sufficient research to fully understand what is included and what is not included. Customer agrees to be bound by the outcomes disclaimer stating that results are not guaranteed and we do NOT guarantee any amount of views, income, or business growth.

LIMITED LICENSE
By purchasing the membership, Customer is granted one limited, revocable, non-transferable, non-sublicensable, non-exclusive license to access and use the content provided within Trail Guide Content Club, for Customer’s personal use only. All intellectual property rights remain with Company. Nothing in this Agreement constitutes a transfer of intellectual property ownership.

Customer agrees not to copy, reproduce, edit, duplicate, modify, publish, transmit, create derivative works from, sell, assist in the sale of, distribute, display, or otherwise exploit Company’s intellectual property without Company’s express written consent. Violations may result in legal action and revocation of access without refund.

USAGE
This subscription is for personal or business use only by the Customer. You may apply strategies and templates for your own content or the content of clients you personally manage. You may not share login credentials or redistribute membership content.

Templates, strategies, and tools inside the Club must be customized and may not be re-sold, redistributed, or used to create competing offers (e.g., ad guides, memberships, social media templates).

Use of this content for "inspiration" to create similar offers is still considered a violation of Company’s intellectual property.

Violations may result in immediate termination of access and legal action.

PAYMENT
Customer agrees to pay Company a recurring subscription fee or full payment as stated at time of purchase. Payment will be processed electronically through Company’s site or its third-party provider. Customer authorizes automatic billing for recurring payments unless or until canceled according to the subscription’s cancellation policy.

REFUND POLICY
Due to the digital nature of this subscription, all sales are final and no refunds will be issued. Customer understands and agrees to this policy before purchasing.

CHARGEBACKS
Attempting a chargeback after accessing the membership is a breach of this agreement. Company reserves the right to dispute chargebacks and pursue collection for the full value of the purchase plus any related fees.

COMMUNICATIONS
All customer inquiries can be sent to hello@trailguidecreatives.com. Company will respond within two business days.

TESTIMONIALS
Company may request testimonials from Customers. These are voluntary. If provided, Customer grants permission for their name, likeness, and feedback to be used in marketing without compensation.

NO GUARANTEES
Customer understands that Company does not promise or guarantee any specific business results, income, views, or sales from using the membership content. All content is provided “as is” for educational purposes and should not be considered professional legal, financial, or business advice.

DISCLAIMER
Company provides content strategy education and tools, not legal or financial advice. Customer is encouraged to consult a licensed professional before implementing any strategy presented inside the membership.

ASSUMPTION OF RISK
Customer accepts all responsibility for decisions made based on membership content and agrees not to hold Company liable for any results or lack thereof.

LIMITED LIABILITY & INDEMNITY
Company’s total liability is limited to the amount paid by Customer. Customer agrees to indemnify and hold harmless the Company and its team against any claims, losses, or damages related to this purchase.

GOVERNANCE
This agreement is governed by the laws of the State of Nebraska.

ENTIRE AGREEMENT
These Terms of Service represent the full agreement between Customer and Company and override any prior communications. No waiver or modification shall be binding unless in writing and signed by both parties.

CHANGES TO TERMS
Company reserves the right to revise these Terms at any time. Continued use of the membership constitutes agreement to the updated Terms.

FINAL
By purchasing Trail Guide Content Club, Customer acknowledges and agrees to all terms listed above.
